Is there a time limit? 

Deadlines and time limits are paramount in the legal system.  If an application is to be made under the Wills Variation Act, s.3 details that, "the action must be commenced within 6 months from the date of the issue of probate of the will in British Columbia or the resealing in British Columbia of probate of the will".   

There is no provision allowing for extensions in special circumstances.   

UPDATE:  When the WESA comes into force on March 31, 2014, the limitation period will change due to s.61 from 6 months to 180 days.
